How to Apply for an ITIN After Forming an LLC

A taxpayer whose ITIN has been deactivated and needs to file a U.S. return can reapply using Form W-7, Application for IRS Individual Taxpayer Identification Number. – When someone who has US citizenship but has never lived in the US as an adult, including so-called Accidental Americans (born abroad to US parents), discover they need to file a US tax return. The IRS sent out renewal letters called the CP-48 notice to people with expiring ITINs, so if your ITIN is expiring, you should have already received this notice. If your ITIN Application is approved, you will receive a CP-565A notice, however, you may also receive other notices from the IRS, as listed below. 6d.) U.S. residents or non-citizens must have an ITIN number in accordance with the Revenue Code to file their tax returns. An Individual Taxpayer Identification Number (ITIN) is a tax processing number issued by the Internal Revenue Service (IRS). People who need a U.S. taxpayer identification number but are unable to receive a Social Security Number (SSN) from the Social Security Administration must acquire an ITIN number for tax purposes. Regardless of how you chose to submit your application, you are required to fill out a W-7 form. GOV+ can help streamline this process to fill out the required paperwork. They don’t entitle the taxpayer to Social Security benefits, stimulus payments, or other benefits.

Applying for and using an ITIN.

You will usually file an ITIN application, Form W-7, Application for IRS Individual Taxpayer Identification Number, with your first tax return, which you must file as a paper return, not electronically. All the exceptions are listed in the ITIN application instructions. You can apply for an ITIN any time during the year when you have a filing or reporting requirement. At a minimum, you should complete Form W-7 when you are ready to file your federal income tax return by the return’s prescribed due date.

ITINs are issued to both resident and nonresident aliens (“alien” is the legal term for foreigner), since the IRS does not get involved with immigration. ETIAS Visa Waiver for Foreigners Visiting the EU

If you are a foreigner and you formed an LLC in the U.S., you will need to speak with an accountant to determine if you owe U.S. taxes. Most people who form an LLC in the U.S. will have a federal tax filing requirement in the U.S. This means that anyone who is required to file taxes in the U.S. will be eligible for an ITIN, no matter their immigration status. Many applicants have reported the IRS lost their passports or other valuable and hard-to-replace identification documents. Consider getting certified copies or using one of the application methods listed below, rather than mailing original identification documents to the IRS.

Bring it to your local IRS office, or use an acceptance agent (colleges, financial institutions, or accounting firms that are authorized by the IRS to assist applicants in obtaining ITINs). They’ll review the W-7 and documentation before sending it to the IRS. Any applicant who meets an exception to the requirement to file a tax return must provide documentation to support the exception (see the instructions for Form W-7).

Certifying Acceptance Agents and many Taxpayer Assistance Centers, discussed below, may also certify certain documents. Beginning January 1, 2011, if you are a paid tax preparer you must use a valid Preparer Tax Identification Number (PTIN) on returns you prepare.

The IRS wants either your original passport or a certified copy of your passport. We recommend working with an accountant that is an IRS Acceptance Agent as they will be able to help you obtain a certified copy of your passport. Getting a certified copy of your passport is a lot better than sending in your original and having to wait multiple weeks before you get it back.

If you don’t certify your passport, you’ll need to send the IRS your original passport. That can be especially stressful if you need to travel soon or you’re currently traveling in how to calculate working capital the U.S. Instead, when hiring an accountant, they can certify your passport for you and send that in along with your ITIN Application (instead of using your original passport).
